DECLARAÇÃO DE CESSÃO E TRANSFERÊNCIA DE DIREITOS PATRIMONIAIS SOBRE ARTIGO PUBLICADO NA REVISTA FSA E AUTORIZAÇÃO PARA PUBLICAÇÃO EM MEIO ELETRÔNICO

O AUTOR, nos termos da lei n. 9.610 de 19 de fevereiro de l998, pelo presente instrumento particular, declara a quem possa interessar, que cede e transfere, em caráter universal, definitivo, irretratável, com exclusividade e a titulo gratuito, a totalidade dos seus direitos patrimoniais de autor sobre seu artigo publicado, à Associação Teresinense de Ensino, na cidade de Teresina-PI, para publicação na Revista FSA.

O AUTOR garante:

  1. Que o artigo é original, excetuando-se as citações de outras obras publicadas, desde que observadas as limitações expressas nos artigos 46 e 47 da Lei 9.610 de 19.02.1998;
  2. Que o artigo não contém quaisquer declarações caluniosas ou difamatórias e que não infringe quaisquer direitos de propriedade intelectual, comercial ou industrial de terceiros;
  3. Ressarcir prontamente a Associação Teresinense de Ensino por quaisquer indenizações, prejuízos ou despesas que advenham em razão da quebra das garantias expressas nas alíneas 1 e 2, acima.

Com esta cessão e transferência dos direitos patrimoniais referentes ao direito do autor, à Associação Teresinense de Ensino e seus sucessores ficam livres de qualquer pagamento de direitos autorais ao AUTOR ou a seus herdeiros ou sucessores.

O AUTOR declara, ainda, que a Associação Teresinense de Ensino está plenamente autorizada a utilizar o referido artigo, no todo ou em parte, editado ou integral, em língua portuguesa e em todas as outras línguas, em versão impressa, em meio eletrônico, internet, para fins comerciais ou não, inclusive podendo distribuir, adaptar, criar obra derivada, ceder seus direitos a terceiros, no Brasil e/ou no exterior, incluindo, mas não limitando a fins de: ensino, estudo e pesquisa; publicação e divulgação; citação; utilização em meios de telecomunicação em geral; utilização audiovisual em geral, incluindo todas as tecnologias digitais existentes ou que venham a ser desenvolvidas no futuro, aptas ao armazenamento e reprodução de dados.

Ficam assegurados ao AUTOR os direitos morais sobre seu artigo, inclusive a vinculação de seu nome como autor do artigo objeto desta transferência.

O AUTOR deverá sempre realizar consulta por escrito à Associação Teresinense de Ensino, por intermédio da Revista FSA, quando pretender qualquer tipo de utilização do seu trabalho ora cedido, obrigando-se ainda, a sempre inserir o crédito à publicação original de seu artigo, citando a referência bibliográfica completa, de modo legível e com destaque.

 

STATEMENT OF ASSIGNMENT AND TRANSFER OF RIGHTS SHEETS ON ARTICLE PUBLISHED IN THE JOURNAL FSA AND AUTHORIZATION FOR PUBLICATION IN ELECTRONICALLY

The AUTHOR, in accordance with law n. 9610 to February 19, l998, hereby particular states to whom it may concern, that assigns and transfers, universal, permanent, irreversible, exclusively and free of charge, all of the economic rights of authors in their article published, the Associação Teresinense de Ensino in the city of Teresina-PI, for publication in the Revista FSA.

The AUTHOR warrants:

1. That the article is original, except for the quotes from other published works, provided that subject to the limitations set out in Articles 46 and 47 of Law 9610 of 19.02.1998;

2. That the article does not contain any libelous or defamatory statements and does not infringe any intellectual, commercial or industrial property of third parties;

3. Promptly reimburse the Associação Teresinense de Ensino for any damages, losses or expenses arising out on account of the breach of the express warranties in paragraphs 1 and 2 above.

With this assignment and transfer of the property rights related to the right of the author and their successors to Associação Teresinense de Ensino shall be free of any payment of copyright to the author or his heirs or successors rights.

The author also states that Associação Teresinense de Ensino is fully authorized to use the Article in whole or in part, edited or in full, in English and all other languages, in print, electronic media, internet for commercial purposes or not, including being able to distribute, adapt, create derivative work, assign its rights to third parties, in Brazil and/or abroad, including but not limited to purposes: teaching, study and research, publication and dissemination; citation, use in telecommunications media in general; audiovisual use in general, including all existing or that may be developed in the future digital technologies, suitable for the storage and playback of data.

Are ensured to AUTHOR moral rights in your article, including linking your name as the author of the article under this transfer.

THE AUTHOR should always perform query in writing to Associação Teresinense de Ensino, through the Revista FSA, when you want to use any of your work now assigned, forcing himself still, always insert the credit to the original publication of his article, citing full bibliographic reference, legibly and prominently.
