DIREITOS FUNDAMENTAIS E A QUESTÃO DA SUSTENTABILIDADE: REFLEXÕES SOBRE DIREITO À SAÚDE E A QUESTÃO DA QUALIDADE DA ÁGUA PARA CONSUMO HUMANO / FUNDAMENTAL RIGHTS AND THE QUESTION OF SUSTAINABILITY: REFLECTIONS ABOUT RIGHT HEALTH AND THE QUESTION WATER

Abstract

O presente trabalho pretende analisar o direito à saúde como direito fundamental, dentro do contexto dos direitos sociais e das necessidade humanas básicas. O direito à agua como direito fundamental no qual serão vistas as questões do direito à água potável e ao saneamento básico e da qualidade da água para o consumo humano, assim como as conseqüentes doenças relativas ao consumo de agua contaminada, seja ela poluição química ou biológica. Ademais importante para a questão da sustentabilidade e do desenvolvimento sustentável é a analise da obra de Nicholas Georgescu-Roegen, tendo-se em conta elementos transdisciplinares da mesma, estes  relativos à economia, à física e também à necessidade de mudança de paradigma do antropocentrismo para o geocentrismo.

ABSTRACT

This paper discusses the right to health as a fundamental right within the context of social rights and basic human need. The right to water as a fundamental right which will be seen in the issues of the right to drinking water and sanitation and water quality for human consumption, as well as the consequent diseases related to the consumption of contaminated water, whether biological or chemical pollution . Also important to the issue of sustainability and sustainable development is the analysis of the work of Nicholas Georgescu-Roegen, taking into account elements of transdisciplinary same, these relating to economics, physics, and also the need for a paradigm shift from anthropocentrism to geocentrism
